Terms of Service

1. Parties and Agreement
These Terms of Service (“Terms”) form a legally binding contract between you (“Customer”, “you”) and Spectrae (“Spectrae”, “we”, “us”), the operator of the Spectrae browser automation platform accessible at spectrae.dev.
By creating an account, adding payment details, or using the Service in any way, you accept these Terms in full. If you are acting on behalf of an organisation, you warrant that you have authority to bind that organisation to these Terms.
If you do not accept these Terms, you must not use the Service.
2. The Service
Spectrae provides on-demand, hosted browser sessions via Playwright-compatible endpoints. Available engines include Chromium and Camoufox (a hardened Firefox fork). Sessions are billed on a usage basis from a prepaid balance held on your account.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable. We may introduce new features, retire old ones, or change pricing with reasonable notice.
3. Accounts and Registration
You must provide accurate and complete registration information and keep it up to date. You are responsible for all activity that occurs under your account. You must not share your API keys or account credentials with unauthorised third parties.
You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. Accounts registered by automated means are prohibited.
We may require identity verification at our discretion before allowing access or processing payments.
4. Acceptable Use
You may use the Service only for lawful purposes. You must not use Spectrae to:
- Access any system, network, or service without authorisation from the owner;
- Scrape, harvest, or extract data in violation of a target website’s terms of service, robots.txt directives, or applicable law;
- Conduct credential stuffing, brute force, account takeover, or any form of unauthorised authentication attempt;
- Send spam, unsolicited commercial communications, or any bulk messaging prohibited by law;
- Distribute malware, ransomware, spyware, or any malicious code;
- Engage in fraud, phishing, identity theft, or any deceptive practice;
- Engage in, facilitate, or support denial-of-service or distributed denial-of-service (DDoS) attacks;
- Violate any intellectual property right, including reproducing copyrighted content without authorisation;
- Create, access, or distribute child sexual abuse material (CSAM) or any content involving the sexual exploitation of minors — this is an absolute prohibition;
- Violate any applicable export control, sanctions, or trade embargo laws;
- Circumvent, disable, or interfere with security features of any system or service;
- Resell, sublicence, or provide third-party access to the Service without our prior written consent;
- Use the Service in any way that imposes a disproportionate or unreasonable load on our infrastructure;
- Attempt to reverse engineer, decompile, or access any part of the Spectrae platform not exposed through our documented API.
This list is illustrative, not exhaustive. We may determine at our sole discretion that use constitutes abuse even where not explicitly listed above.
5. Prepaid Balance and Billing
Prepaid model. The Service operates on a prepaid basis. You must maintain a positive account balance to start new sessions. New accounts receive a one-time starting balance as stated on our pricing page.
Usage charges. Sessions are billed per second at the rates published on our pricing page at the time of use. A minimum charge per session applies as stated on the pricing page. Rates are quoted in USD exclusive of any applicable taxes.
No subscription. We do not charge a recurring subscription fee. Your balance is debited as you use the Service. Balance does not expire.
Top-ups. You may add balance at any time in the fixed increments published on our pricing page. All top-up payments are processed by our payment provider (Stripe) and are non-refundable except as expressly stated in these Terms.
Zero balance. When your balance reaches zero, new sessions will be blocked and active sessions will terminate gracefully. We are not liable for any loss arising from session termination due to insufficient balance.
Taxes. You are responsible for all taxes applicable to your use of the Service in your jurisdiction. Where we are required by law to collect VAT or similar taxes, we will add them to your payment.
6. Refunds
General rule. All payments are non-refundable. Given the nature of the Service — on-demand compute consumed in real time — we do not offer refunds on used or unused balance except as required by applicable law or as set out below.
Abuse termination — no refund. If your account is terminated or suspended for violation of the Acceptable Use policy (clause 4), any remaining balance is forfeited in full and will not be refunded. This applies regardless of the amount of remaining balance and is in addition to any other remedies available to us.
Service failure. If a demonstrable platform failure on our part results in sessions being charged without usable output, we will credit your account with the affected usage at our discretion. This is a goodwill credit, not a refund, and does not entitle you to a cash payment.
Statutory rights. Nothing in this clause affects any statutory rights you may have under applicable UK consumer protection law where you are acting as a consumer. Business customers acknowledge that the Consumer Rights Act 2015 cancellation rights may not apply to digital services fully performed with your consent.
7. Suspension and Termination
Termination by you. You may close your account at any time by contacting us at [email protected]. Closure does not entitle you to a refund of any remaining balance except as required by law.
Termination or suspension by us. We may immediately suspend or terminate your account, without notice and without liability, if:
- You breach any provision of these Terms, including the Acceptable Use policy;
- We reasonably suspect fraudulent, abusive, or illegal activity;
- Continuation of your access poses a risk to our platform, other customers, or third parties;
- We are required to do so by applicable law or a competent authority.
Effect of termination. On termination for breach or abuse, all remaining balance is forfeited (see clause 6). We have no obligation to provide advance notice of termination for cause. We will provide reasonable notice of termination for any other reason where practicable.
Disputes. If you believe a termination was made in error, you may contact us at [email protected] to raise a dispute. We will review in good faith but make no guarantee of reinstatement.
8. Intellectual Property
All rights in the Spectrae platform, including software, branding, documentation, and APIs, are owned by or licenced to us. These Terms do not transfer any ownership to you. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service solely in accordance with these Terms.
You retain all rights in any content or data you submit to or retrieve via the Service. You grant us a limited licence to process such content as necessary to provide the Service.
9. Confidentiality
Your API keys are confidential. You must not share them publicly, commit them to public repositories, or allow unauthorised access. You are liable for all usage under your API keys. If you suspect a key has been compromised, you must revoke it immediately via the dashboard.
10. Data Processing
Our collection and processing of personal data is described in our Privacy Policy. Where you use the Service to process personal data of third parties, you are responsible for ensuring you have a lawful basis for that processing. Spectrae acts as a data processor in relation to any personal data passing through browser sessions initiated by you.
11. Disclaimers and Warranties
The Service is provided “as is” and “as available” without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any particular website will be accessible via our browser endpoints.
We make no representation that using the Service will be lawful in your jurisdiction or for your particular use case. You are solely responsible for ensuring your use complies with applicable law.
Nothing in this clause limits any warranty implied by law that cannot be excluded.
12. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable to you for any:
- Loss of profits, revenue, or business;
- Loss of data or corruption of data;
- Loss of goodwill or reputation;
- Indirect, incidental, special, or consequential loss;
- Loss arising from your reliance on the Service for any time-critical or business-critical purpose.
Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount you have paid to us in the three (3) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
13. Indemnity
You agree to indemnify, defend, and hold harmless Spectrae and its officers, employees, and agents from and against any claims, damages, losses, and costs (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any content processed by you through the Service.
14. Third-Party Services
The Service may depend on or integrate with third-party services including payment processors (Stripe) and infrastructure providers. We are not responsible for the availability, accuracy, or practices of any third-party service. Your use of third-party services is governed by their respective terms.
15. Changes to These Terms
We may update these Terms at any time. Where a change is material, we will provide notice by email to your registered address or by a prominent notice in the dashboard at least 14 days before the change takes effect. Continued use of the Service after the effective date of any change constitutes acceptance of the revised Terms.
16. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable law requires otherwise.
Before commencing formal proceedings, you agree to contact us at [email protected]to attempt to resolve the dispute informally. Nothing in this clause prevents either party from seeking urgent injunctive or other interim relief.
17. General
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spectrae regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
No waiver. Failure to enforce any provision of these Terms is not a waiver of our right to enforce it in the future.
Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
